Gabrielle Union Has Something to Say

In early December, Union met with representatives from NBC and Fremantle for a five-hour conversation, after which NBC announced that the network would conduct an internal investigation. Per Variety, an NBC spokesperson said at the time: “The initial conversation was candid and productive. While there will be a further investigation to get a deeper understanding of the facts, we are working with Gabrielle to come to a positive resolution.” In January, the Hollywood Reporter reported that NBC entertainment chief Paul Telegdy addressed the investigation publicly at the Television Critics Association’s winter press tour. “I’m confident, if we learn from this investigation, we’ll put new practices in place, if that’s what’’s necessary,” he said. “We take the investigation very seriously.”
In late May, NBC, Fremantle, and Syco released a joint statement about the results of the investigation, according to Deadline. The statement says, among other things, that the investigation found that Union did not lose her job because of her complaints about culture. “While the investigation has demonstrated an overall culture of diversity, it has also highlighted some areas in which reporting processes could be improved,” the statement also said. And then in early June, Union filed a discrimination complaint with the state of California against NBC, Fremantle, Syco, and Simon Cowell; in the complaint, she also accused Telegdy of trying to intimidate her (through her agent) over speaking out about her experiences. Per Variety, NBC issued a statement denying the allegations. Union’s lawyer then responded with a statement as well (you can read both statements here). As of press time, the situation is ongoing.
In our conversation back in May, Union addressed her experiences with AGT, although she never mentioned the show, network, production company, or Cowell by name. She said that she had been absolutely thrilled at the opportunity to work on the show, calling it a “dream job,” but that she experienced problems from the very beginning, which put her in the unfortunate and uncomfortable position of having to complain about Cowell, the executive producer and owner of the show, on her first day on the job.
“Day one, my boss—who owned the show, executive producer, and lead judge—is chain-smoking cigarettes inside,” she said. “Like, openly flouting the law. And no one’s doing anything.”
She realized that if she wanted something done about it, she’d have to be the one to make that happen. “I’m sitting there like, I don’t want to be this girl. Day one? Like, day one on this dream job? Like…come on.” She said she shared that she’s allergic to cigarette smoke—that it impacts her respiratory system, and affects her voice, and would affect her ability to do her job—and could he please stop? “And everyone’s like, ‘Aahh, yeah, you know, we can ask?’” she recalled, laughing in the retelling. “And I’m like, Well, it’s, like, a law? So I don’t even think you really have to ask, right? It’s just, like, the law. So…”
Union attributes this moment to the beginning of her troubles at the show. “The second I had to ask to, you know, not be poisoned at work, I became a problem,” she said.
It wasn’t just about her own health, she said—she felt like she had to stand up for everyone else also. “There’s no way I feel okay about allowing someone to openly flaunt breaking the law and exposing all of the dope crew and the production and the talent, and all these people, to carcinogenic toxic chemicals—the legit definition of a toxic work environment. Who am I if I can’t stand up in this? It’s legit. It’s not an opinion; this is the law. I should never have been put in this position, and there should have been measures put in place to deal with these kinds of things, and it should never have been put on me. But here we go. And I have to say something, and I have to stand up for all of us. But with that can come consequences.”
